detained at the airport, Chicago immigration attorneys,  lawful permanent residents, green card holders, immigration statusSince late January 2017, various iterations of an executive order on immigration have been in force at all U.S. ports of entry, but have seen the most controversy at airports. The most recent permutation as of this writing, after input from the Supreme Court in the form of an unsigned opinion, excludes non-citizen nationals from seven majority Muslim countries—Iraq, Iran, Libya, Sudan, Somalia, Syria and Yemen—unless they can prove a “bona fide relationship” to any “person or entity” in the United States.

However, the opinion does not define such a standard, which means that the definition is largely being left up to immigration personnel on the ground. This can cause problems for travelers, even if you are not a national of one of the seven countries on the president’s “list.”

As one navigates through the process of obtaining visas and more permanent status, it is not uncommon to become confused about one’s rights and responsibilities. Nowhere is this more fraught than if one is awarded a green card, which confers lawful permanent residence (referred to commonly as ‘LPR status’) on the holder. Upon being granted your green card, you are also granted rights under the law which cannot be taken away unless you lose your status. 

More Than a Visa, Less Than Citizenship

Rather than relying on immigrant visas like H1Bs or F1s, LPR status is very often a kind of intermediate status for those who have reasons to live or work in the United States, but may not wish to renounce his or her original citizenship. It is also common to see LPRs who received their green cards via relief applications, such as those who apply each year under the Violence Against Women Act (VAWA). Either way, lawful permanent residents have rights and responsibilities that are enshrined in the law, and may not be taken away unless they are stripped of their green card. Many of these rights are things that citizens take for granted, but LPRs often do not have that luxury.

Cancellation of removal replaced an old program referred to as suspension of deportation (SoD). The problem with SoD is that it did not discriminate; it did not give a different standard to legal permanent residents (LPRs) who had been in the country lawfully and to people not lawfully in the United States. Cancellation of removal does have different standards for both categories, though in both cases, it is entirely at the discretion of the immigration judge.
