Under the Nicaraguan Adjustment and Central American Relief Act (NACARA), relief from deportation and legal permanent resident status is available for certain Nicaraguans, Salvadorans, Cubans, Guatemalans, and nationals of former Soviet Bloc countries. Who Is Eligible for NACARA Relief?

Section 202 of NACARA applies to certain Nicaraguans and Cubans while Section 203 applies to certain Guatemalans, Salvadorans and former Soviet Bloc nationals. Eligibility to apply for NACARA relief depends on your nationality, when you entered the United States and when you applied for asylum. NACARA allows qualified individuals to receive suspension of deportation or cancelation of removal if they are able to show the following:

  • Continuous presence in the United States for at least the past seven years (you may have a total of no more than 90 days out of the country on a single trip and a total of no more than 180 total days out of the country to meet the definition of “continuous”).
  • Good moral character.
  • Your removal would result in extreme hardship to you or to your spouse, parent, or child who is a U.S. Citizen or U.S. legal permanent resident (LPR).
  • You deserve to obtain deportation relief.
