Foreign nationals who want to study in the United States must obtain a student visa. International students must attend accredited colleges, universities and other approved educational institutions. In addition, qualified applicants must be enrolled in full-time study programs. F Category Student Visas

F1 visas and F3 visas, also known as academic student visas, are used for foreign students who want to study full-time at qualified academic institutions; such as accredited universities, colleges, conservatories, seminaries, academic high schools and elementary schools. F2 visas are also available for foreign students who have a spouse and minor children they want to accompany them while studying in the U.S.

To be eligible for an F1 or F3 student visa, applicants must meet the following requirements:

  • Have a permanent foreign residence that they do not intend to abandon;
  • Be proficient in English or enrolled in courses that will lead to English proficiency;
  • Have been accepted by a USCIS-approved academic institution and have an I-20 issued by the institution;
  • Demonstrate the financial capability to support themselves for the duration of their course of study; and
  • Intend to depart from the U.S. upon completion of their course of study.

M Category Student Visas

Foreign students who wish to study in full-time vocational or other non-academic training programs may apply for an M1 visa or M3 visa. M2 visas are also available for spouses and minor children of non-academic students. The requirements for M category student visas are as follows:

  • Have a permanent residence abroad they do not intend to abandon;
  • Be proficient in English or enrolled in courses that will lead to English proficiency;
  • Acceptance in a USCIS-approved vocational or non-academic program/institution and issuance of an I-20 from the approved institution;
  • Demonstration of financial capability to support themselves through the duration of their time studying in the U.S.; and
  • Intention to depart from the U.S. upon completion of studies.

Once coursework is completed, foreign students sometimes seek to adjust their status to remain in the U.S. For example, if hired by a U.S. company, they may apply for an employment-based visa. Or if getting married to a U.S. citizen, they may seek to apply for a fiancé visa. Adjustment of status can be tricky, and it is important to provide full and complete documentation to gain approval.
