Illinois immigration lawyerLearning that the U.S. visa you or your loved one in another country applied for has been denied can be frustrating. For some, it can even be frightening. You may have an idea of why you were denied, or you may have been blindsided by the denial. Even if your initial application for a visa was denied, there may be steps an attorney can help you take to ultimately get approved.

It is important to understand the reason for your denial in order to potentially overcome any issues and get a visa. What your next steps could look like may depend on the reason for your denial and whether it is temporary or permanent in addition to whether it is waivable. An immigration attorney can help you better understand why you or your loved one was denied and what to do next.

What Are Some Common Reasons U.S. Visa Applicants Get Denied?

There are a few very common reasons that U.S. visa applications are not accepted. Yours is more likely than not among them. Some are temporary and can be overcome. These reasons for denial include:

  • Incomplete application - If you were denied for this reason, this just means that your application was missing some information or there was a problem with your supporting documentation. The good news is that this type of denial is less of a true denial and more of a request that you submit more information and resubmit.
  • Unlawful presence - If you either overstayed a temporary visa without properly extending, or entered the country illegally, this could be grounds for denial. Depending on how long you were unlawfully present in the country, you may be able to reapply in three to ten years.
  • Public assistance concerns - This type of denial means that the U.S. consular officer believes that you will not be able to support yourself upon arrival and will most likely become dependent on public assistance programs to survive. There are ways to overcome this reason for denial. You may be able to demonstrate that this is not the case.
  • Fraud or misrepresentation - If you were denied because you misrepresented yourself in some way on the application or committed fraud, then you will be permanently ineligible for a U.S. visa. This could mean that you attempted to hide a criminal conviction or were dishonest about whether you have family in America. This cause for denial is rarely waivable.

These are just a few of the more common reasons U.S. visas are denied. An attorney can help you determine whether your reason for denial is something that can be overcome in your situation.
