Chicago immigration attorneysOn January 27, 2017, U.S. President Donald Trump issued Executive Order 13769, entitled “Protecting the Nation From Foreign Terrorist Entry Into the United States.” The executive order instituted a number of changes to the nation’s policies and procedures regarding immigration and banned individuals from seven specified countries from entering the United States. The order—which has become known as a “travel ban”—prohibited entry into the U.S. for aliens from Iraq, Iran, Libya, Somalia, Sudan, Syria, and Yemen for a period of 90 days.

According to reports, thousands of legally-issued travel visas were canceled immediately, and hundreds of travelers from these countries were denied entry. Some were even detained by immigration authorities. Within days, Washington state filed a lawsuit against the U.S. government, claiming that the executive order was illegal and unconstitutional and asking for a temporary restraining order (TRO) that would halt the order’s enforcement. Last week, a federal judge granted the TRO finding that the travel ban was likely to be proven unlawful. The federal government filed an emergency appeal asking for the TRO to be lifted.

b2ap3_thumbnail_help-refugees-illinois.jpgThere will be coordinated humanitarian effort on January 30, 2017 to help those immigrants detained at O’Hare Airport as a result of the recently imposed ban on immigrants based upon nationality.  Attorney Matthew Sperry who is the Vice Chair of the DuPage County Bar Association (DCBA) Immigration Law Committee will be spearheading the effort to connect volunteers with organizations on the ground at O’Hare.  This is not a political event; it is a humanitarian effort.  That is the focus.  Organizations on the ground at O’Hare airport already have an apparatus in place and will be leading the effort.  Here is a message from Matt Sperry: 

Executive Orders were signed this past Friday suspending all refugee admissions for 120 days, suspending Syrian refugees indefinitely, and blocking admissions for all visa holders and lawful permanent residents from seven different countries (Iraq, Iran, Syria, Somalia, Sudan, Libya, and Yemen) without notice.  Dozens of individuals across the country are being detained (including at O'Hare International Airport) at ports of entry pending removal (also called deportation), separating families, and permanent residents who have lived in the US for years are facing being stranded abroad.  There have also been  reports of individuals entering the US with dual citizenship (including dual US Citizenship) being detained, as well as a BBC reporter, Iraqi permanent residents who obtained their status through service to the U.S. military during the Iraq war, physicians, and permanent resident parents of US Citizen children under 21, among others. 

As of the time of drafting this email, there is pending federal litigation which includes a stay of removal as of Saturday night, but not detention. Department of Homeland Security (DHS) Officials are continuing to detain individuals at O'Hare arriving on incoming flights.  In light of this humanitarian and constitutional crisis, several advocacy groups, including the American Civil Liberties Union, the International Refugee Assistance Project, and Lawyers for Good Governance are offering pro bono assistance to individuals being detained by DHS, and are calling out for attorney volunteers to assist the detainees.
